Seven16 Group Terms of Service

The master terms for Seven16 Group, LLC and its products and services, including DOT Intel — followed by the DOT Intel beta addendum.

1. Agreement and acceptance

These Terms of Service ("Terms") govern access to and use of the Services offered by Seven16 Group, LLC, including websites, software applications, SaaS platforms, APIs, dashboards, reports, data products, and related services, including DOT Intel and any other products or domains that link to these Terms.

By accessing, registering for, purchasing, or using the Services, the user or customer agrees to these Terms.

If a user is accessing the Services on behalf of an entity, that user represents that they have authority to bind the entity to these Terms.

2. Services

The Services are business-oriented software and information services designed to support commercial operations, analytics, workflow management, intelligence, sales, underwriting support, insurance operations, transportation operations, and related use cases.

Features, content, pricing, usage models, and availability may vary by product, plan, order form, statement of work, or other written agreement.

3. Accounts and access

Users must provide accurate registration and billing information and keep it current.

Users are responsible for maintaining the confidentiality of credentials and for all activities occurring through their accounts.

Seven16 Group may suspend access if there is a reasonable belief of credential compromise, abuse, fraud, nonpayment, legal risk, or violation of these Terms.

4. Subscription and credit-pack terms

The Services may be offered on a subscription basis, usage-based basis, prepaid credit-pack basis, or a hybrid model combining recurring subscriptions with consumption-based entitlements.

Unless otherwise stated in an order form or separate written agreement:

  • Subscriptions renew automatically for successive billing periods unless canceled before the applicable renewal date.
  • Fees are due in advance or as otherwise invoiced and are non-refundable except as required by law or expressly stated in writing.
  • Credit packs, usage entitlements, lookup credits, or similar prepaid units may expire if not used within the stated validity period, and unused amounts are non-refundable unless required by law or otherwise stated in writing.
  • Seven16 Group may modify pricing, packaging, or credit consumption rules prospectively upon reasonable notice.
  • Taxes, duties, and governmental charges are the customer's responsibility except for taxes based on Seven16 Group's net income.
  • Seven16 Group may suspend or downgrade access for overdue accounts after reasonable notice, subject to any applicable contractual cure period.
  • If a separate order form, MSA, or enterprise agreement conflicts with these default billing provisions, the signed written agreement will control for the covered Services.

5. Customer Data, public data, and AI data rights

For purposes of these Terms:

  • "Customer Data" means data, content, files, prompts, instructions, records, and materials submitted to the Services by or for a customer or user.
  • "Public Data" means lawfully obtained information made available from public records, regulatory sources, open sources, or other lawful third-party sources.
  • "Usage Data" means telemetry, logs, interaction data, and metadata generated through use of the Services.
  • "Outputs" means results, summaries, scores, classifications, recommendations, extracts, or other material generated by the Services, including AI-enabled outputs.

5a. Data rights and licenses

As between the parties, the customer retains rights in its Customer Data, subject to the rights granted in these Terms.

The customer grants Seven16 Group a non-exclusive, worldwide, limited license to host, copy, process, transmit, display, adapt, analyze, and otherwise use Customer Data as necessary to provide, maintain, secure, improve, and support the Services and to comply with law.

Unless restricted by a separate written agreement, Seven16 Group may use Customer Data, Public Data, Usage Data, and Outputs in aggregated, de-identified, anonymized, or transformed form to develop, test, tune, monitor, and improve products, analytics, and AI or machine-learning features.

Seven16 Group will not intentionally use de-identified data to re-identify a natural person for model improvement or analytics purposes except where permitted by law and necessary for security, fraud prevention, or legal compliance.

Enterprise customers requesting stricter AI data use limitations, model-training restrictions, or data segregation terms should address those requirements in a signed MSA, DPA, or order form, because those negotiated trade-offs commonly vary across AI-focused SaaS deals.

6. Acceptable Use Policy

Users may use the Services only for lawful, authorized, and legitimate business purposes consistent with these Terms.

Users may not, and may not permit others to:

  • Violate any law, regulation, court order, sanction, or third-party right.
  • Access or use the Services in a way that interferes with, degrades, disrupts, or harms the Services or other users.
  • Reverse engineer, benchmark for competitive replication, scrape, copy at scale, data mine, or otherwise extract data or model behavior except as expressly permitted by Seven16 Group.
  • Attempt to discover source code, model weights, hidden prompts, system instructions, security controls, or confidential architecture.
  • Use the Services to generate or distribute spam, malware, deceptive content, unlawful surveillance, harassment, or fraudulent material.
  • Use AI-enabled features to generate discriminatory, defamatory, unlawful, infringing, deceptive, manipulative, or rights-violating content.
  • Use the Services for fully automated decisions that materially affect legal rights or similarly significant outcomes without appropriate human review and legal compliance.
  • Upload data to the Services unless the user has the necessary rights, notices, and permissions for that upload and processing.
  • Circumvent usage limits, seats, entitlements, rate limits, billing controls, credit consumption rules, or access restrictions.
  • Use the Services to develop or train competing models or competing products except where such use is expressly authorized in writing.

6a. Enforcement

Seven16 Group may investigate violations and suspend or terminate access immediately where necessary to protect the Services, users, third parties, or Seven16 Group.

7. AI disclaimer and output limitations

The Services may incorporate AI, machine learning, and automated decision-support functionality.

AI-generated or algorithmic outputs may be inaccurate, incomplete, biased, non-unique, inconsistent, or outdated and may not reflect current law, regulations, market conditions, or underwriting requirements.

Outputs are provided for informational and workflow-support purposes only and are not guaranteed to be correct, comprehensive, or fit for a particular purpose.

The Services do not provide legal advice, insurance advice, safety advice, brokerage advice, employment screening determinations, consumer reporting services, or guaranteed underwriting decisions unless explicitly stated in a signed written agreement.

Users are solely responsible for independently reviewing and validating outputs before acting on them.

8. Public data and third-party materials disclaimer

The Services may incorporate Public Data and other third-party materials from sources believed to be reliable, but Seven16 Group does not control those sources and does not warrant their accuracy, completeness, legality, timeliness, or continued availability.

Changes, delays, removals, errors, or formatting issues in source systems may affect outputs in the Services.

9. Intellectual property

Seven16 Group and its licensors retain all rights, title, and interest in and to the Services, including software, interfaces, workflows, dashboards, documentation, trademarks, scoring methods, models, prompts, templates, visual design, and all related intellectual property rights, except for Customer Data rights expressly reserved to the customer.

No rights are granted except as expressly stated in these Terms.

10. Feedback

If a user provides suggestions, ideas, enhancement requests, corrections, or feedback regarding the Services, Seven16 Group may use that feedback without restriction or compensation, unless prohibited by a separate written agreement.

11. Confidentiality

If Seven16 Group receives non-public information designated or reasonably understood to be confidential, Seven16 Group will use reasonable care to protect that information and use it only as needed to perform under these Terms, subject to legal obligations and the Company's rights regarding de-identified, aggregated, or transformed information.

Confidentiality obligations do not apply to information that is public without breach, already known without obligation, independently developed, or lawfully received from another source.

12. Term and termination

These Terms remain effective until terminated.

A user may stop using the Services at any time, but termination does not relieve payment obligations already incurred.

Seven16 Group may suspend or terminate access immediately or prospectively for violation of these Terms, legal risk, security risk, misuse of AI features, infringement claims, nonpayment, or harmful conduct.

Upon termination, rights to access the Services end, though provisions that by their nature should survive will survive, including provisions relating to payment obligations, IP rights, confidentiality, disclaimers, limitations of liability, indemnity, dispute resolution, and data rights relating to de-identified or aggregated information.

13. Warranties disclaimer

To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis.

Seven16 Group disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted service, and error-free operation.

14. Limitation of liability

To the maximum extent permitted by law, Seven16 Group will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, data, or business opportunities arising out of or related to the Services.

To the maximum extent permitted by law, Seven16 Group's aggregate liability arising out of or relating to the Services will not exceed the greater of the amounts paid by the customer to Seven16 Group for the affected Services during the twelve months preceding the event giving rise to the claim or one hundred U.S. dollars.

Some jurisdictions do not allow certain limitations, so some portions of this section may not apply in full.

15. Indemnification

The user or customer will defend, indemnify, and hold harmless Seven16 Group, its affiliates, and their officers, directors, employees, and agents from and against claims, damages, liabilities, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to Customer Data, misuse of the Services, violation of these Terms, unlawful or infringing content, or violation of law by the user or customer.

16. Governing law and dispute resolution

These Terms will be governed by the laws of the State of Texas, without regard to conflict-of-law rules, unless another governing law is required by a signed written agreement or non-waivable law.

The exclusive venue for disputes arising from these Terms or the Services will be the state or federal courts located in Parker County or Tarrant County, Texas, unless otherwise required by law or agreed in writing.

Before filing a formal claim, the parties should first attempt in good faith to resolve the dispute by written notice sent to legal@seven16group.com.

17. Changes to the Terms

Seven16 Group may update these Terms from time to time.

If changes are material, Seven16 Group may provide reasonable notice before the updated Terms take effect.

Continued use of the Services after the effective date of revised Terms constitutes acceptance of the revised Terms.

DOT Intel Beta Addendum

DOT Intel is offered as a paid beta / evaluation service. Features, pricing, packaging, and availability may change, be limited, or be interrupted; there is no uptime SLA during beta. The paid rail is prepaid one-time credit packs: credits never expire and are non-refundable except where required by law or expressly stated in writing. One credit unlocks a carrier's full workspace (contact, full risk analysis, insurance-history timeline, and the downloadable report) and stays unlocked; already-unlocked carriers are never charged again. Unlocks require the buyer attestation and are blocked for carriers on the do-not-resell list. Bulk / list export is not self-serve during beta. Core FMCSA datasets refresh daily; data is provided as-is and should be verified at the source.

Use of the Services is further governed by the Acceptable Use Policy and the Disclaimers. This addendum sits under the Seven16 Group master Terms above; where they conflict, the master Terms control.
